Factories Act

Purpose & Object

Factories Act, 1948 has been enacted to regulate the working conditions in factories and to ensure provision of the basic minimum requirements for safety, health and welfare of the workers as well as to regulate the working hours, leave, holidays, employment of children, women, etc.

Applicability

  • Factories Act, 1948 extends to whole of India.
  • It applies to factories as defined under the Act.

Coverage

  • Any premises including the precincts thereof where 10 or more workersare or were working on any day of the preceding 12 months and in any part of which a manufacturing process is being carried on with the aid of power or is ordinarily so carried on; or
  • Any premises including the precincts thereof where 20 or more workersare or were working on any day of the preceding 12 months and in any part of which a manufacturing process is being carried on without the aid of power or is ordinarily so carried on

For male child:
Between 6 A.M. and 10 P.M.

Between 8 A.M. and 7 P.M.

No child is permitted to work during night

Overtime

In case of more than 9 hours of work in any day or 48 hours in any week, the worker shall be entitled to overtime wages at the rate of twice his ordinary rate of wages
